1. Definitions

• "Company" means Tokenkart.com, Aizumous.com, and all affiliated entities, directors, officers, employees, partners, contractors, licensors, successors, and assigns ("Protected Parties").
• "Services" means all products, tools, features, Aizom Agents, Aizom Bridge, website, APIs, and future offerings.
• "User" means any person or entity accessing or using the Services.
• "Aizom Agents" means AI-powered agents created using the platform.

2. Eligibility and Acceptance

By using the Services, you represent that: (a) you have legal capacity to enter into this Agreement; (b) you will comply with all applicable laws; (c) you are responsible for all actions under your account, device, or integrations.

3. Description of Services

Aizumous provides a no-code platform to create AI-powered agents.

3.1 Local-First Architecture

• API keys, prompts, and configurations may be stored locally on your browser or device.
• The Company does not control or guarantee the security of such local storage.

3.2 Aizom Bridge

• Users may install scripts on their own devices.
• These scripts operate entirely within the user's environment.
• The Company has no control over execution, security, or outcomes on user devices.

3.3 Future Versions

• Future versions (including "Aizumous Pro") may include hosted infrastructure, mobile apps, and subscription models.
• Features, storage methods, and data handling may change.

4. Third-Party Services and Integrations

The Services depend on third-party providers including AI providers (OpenAI, Gemini, Claude, Groq), messaging platforms (WhatsApp, Telegram, Discord, Slack), browsers, operating systems, and devices.

4.1 User Responsibility

You are solely responsible for: obtaining and securing API keys; managing integrations; complying with third-party terms.

4.2 No Control Disclaimer

The Company does not control and does not guarantee: uptime, availability, or performance; data practices or security; pricing or billing.

4.3 Third-Party Risk Allocation

All risks arising from third-party services are assumed entirely by the User.

5. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the Protected Parties from any and all claims, demands, damages, liabilities, losses, costs, and expenses (including legal fees) arising out of or related to:

• your use, misuse, or inability to use the Services
• any Aizom Agent created, deployed, or operated by you
• any outputs, communications, or automated actions generated
• any transactions or interactions conducted through agents
• any third-party integrations or API usage
• violation of laws or third-party rights
• failure to secure your device, browser, or credentials
• unauthorized access or data breach from your systems
• any past, present, or future claims related to the Services

This indemnity survives termination.

6. AI Agent Responsibility Disclaimer

You acknowledge that: (a) the Services are a tool platform only; (b) agents are fully user-controlled; (c) AI outputs may be inaccurate or unpredictable. The Company bears no liability for agent behavior or outputs, misuse or unlawful deployment, or reliance on AI-generated responses.

7. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Company disclaims all warranties, including: uninterrupted or error-free operation; accuracy or reliability; security or availability; compatibility with third-party systems.

8. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for: indirect, incidental, or consequential damages; loss of profits, revenue, data, or business; service interruptions or failures; reputational or commercial losses.

9. Liability Cap

Since the Services are currently provided free of charge, total liability shall not exceed INR 1 (One Indian Rupee) or the minimum amount required under applicable law, whichever is greater. You acknowledge that all payments are made directly to third-party providers. The Company does not process or control such payments and shall not be liable for API usage fees, third-party subscriptions, or integration costs. If paid services (including "Aizumous Pro") are introduced, liability shall be limited to fees paid to the Company in the previous 3 months.

10. Third-Party and Infrastructure Disclaimer

The Company is not responsible for: AI provider failures; messaging platform issues; browser or device vulnerabilities; Aizom Bridge execution risks; API outages, bans, or restrictions.

11. Service Modifications and Termination

The Company may at any time, without notice: modify or discontinue Services; remove features or integrations; suspend or terminate access; update this Agreement. No liability arises from such actions.

12. Acceptable Use

You agree not to: violate laws; misuse AI agents; engage in harmful or fraudulent automation; infringe third-party rights.

13. Dispute Resolution, Arbitration & Class Action Waiver

To the fullest extent permitted by law: disputes shall first be attempted to be resolved amicably; failing which, disputes shall be resolved by binding arbitration in Patna, Bihar, India. You agree that disputes shall be handled individually — no class actions or collective proceedings are permitted.

14. Governing Law and Jurisdiction

This Agreement is governed by the laws of India. Courts in Patna, Bihar, India shall have exclusive jurisdiction.

1. Data Collection and Storage

1.1 Local Storage Model

• API keys, prompts, and agent data are stored locally on your device or browser.
• The Company does not centrally store such data in the current version.

1.2 Limited Processing

The Company may process limited data such as technical logs, diagnostics, and usage metadata for functionality, security, and improvement.

2. User Responsibility

You are responsible for: securing your device and browser; protecting local storage; managing access to credentials.

3. Data Usage

Data may be used to: operate and improve Services; enable functionality; provide support; ensure security and compliance.

4. Data Sharing

4.1 Business Operations

With partners, vendors, and service providers.

4.2 Legal Compliance

With law enforcement, regulators, or government authorities when required.

5. Third-Party Data Risks

The Company does not control AI providers, messaging platforms, browsers, or devices. The Company is not responsible for data breaches, unauthorized access, or misuse by third parties.

6. Cross-Border Processing

Data may be processed in multiple jurisdictions depending on services and providers used.

7. Future Services and Data Migration

Future versions may involve different data handling. By continuing to use the Services, you agree to such changes.

8. Security Disclaimer

No system is completely secure. You acknowledge risks related to: internet transmission; local storage; third-party integrations.

9. Data Retention

Data may be retained as necessary for: operations; legal compliance; dispute resolution.

10. Jurisdiction

All privacy matters shall be subject to Patna, Bihar jurisdiction only.
